Mini Muskogee Terms of Service and liability waiver

Welcome to Mini Muskogee! These Terms of Service (“Terms”) govern your access to and use of Mini Muskogee facilities, services, memberships, events, field trips, parties, and all related offerings. By visiting our facility, booking a service, purchasing a membership, or participating in any activity, you agree to these Terms. If you do not agree, you may not use our services.

1. General Policies

  • Mini Muskogee is a children’s play facility designed for supervised play and enrichment.
    Parents or legal guardians are responsible for supervising their children at all times unless a specific program provides otherwise.
  • All guests must adhere to facility rules, staff directives, and safety guidelines.
  • Mini Muskogee reserves the right to refuse service or remove any guest who violates safety rules or engages in disruptive behavior.


2. Hold Harmless & Liability Waiver

By entering Mini Muskogee or participating in any activity, you acknowledge and agree to the following:

  • Assumption of Risk: Participation in play activities, events, parties, and field trips involves inherent risks, including but not limited to slips, falls, collisions, and interactions with equipment and other children. You voluntarily assume all risks, known and unknown.
  • Waiver of Liability: To the fullest extent permitted by law, you agree to release, waive, discharge, and hold harmless Mini Muskogee, its owners, employees, contractors, and affiliates from any and all claims, liabilities, demands, injuries, damages, or losses arising from participation in activities or use of the facility, whether caused by negligence or otherwise.
  • Parental Responsibility: Parents and guardians are solely responsible for supervising their children unless otherwise specified by a designated program. Mini Muskogee is not responsible for injuries or incidents resulting from lack of supervision.
  • Medical Treatment Authorization: In the event of injury, you authorize Mini Muskogee staff to obtain emergency medical treatment as deemed necessary. You agree to assume full financial responsibility for any medical services provided.
  • Personal Belongings: Mini Muskogee is not liable for lost, stolen, or damaged personal items brought into the facility.
  • Photography & Media Release: By entering the facility, you grant permission for Mini Muskogee to use photographs or video taken during activities for marketing or promotional purposes, unless you notify us in writing.


3. Emergency Procedures & Evacuation Consent

  • Guests agree to follow all emergency procedures and instructions given by Mini Muskogee staff during fire drills, evacuations, or other safety-related events. Mini Muskogee is not responsible for injuries or issues resulting from a guest’s failure to comply with emergency directions.


4. Injury Reporting Requirement

  • All injuries, incidents, or hazardous conditions must be reported to Mini Muskogee staff immediately upon occurrence. Failure to report an incident at the time it occurs may limit Mini Muskogee’s ability to investigate and may affect any related claim or complaint.


5. Personal Responsibility & Proper Attire

  • Guests must wear appropriate attire, including socks where required, and avoid clothing or accessories that may pose a safety hazard. Mini Muskogee reserves the right to deny access to any play area if a guest’s attire is deemed unsafe.


6. Prohibited Items

  • Guests may not bring any hazardous, sharp, dangerous, or inappropriate items into the facility. Mini Muskogee reserves the right to inspect personal items and remove or prohibit any item deemed unsafe or disruptive.


7. Special Needs / Additional Support Disclosure

  • Parents, guardians, teachers, and group leaders must notify Mini Muskogee if a participating child requires medical, behavioral, or mobility accommodations beyond standard supervision. This disclosure allows Mini Muskogee to help ensure a safe experience for all guests.


8. Party Decor & Outside Items Restrictions

  • Outside decorations, signage, equipment, and supplies—including balloons, confetti, glitter, or electrical items—must be approved by Mini Muskogee prior to arrival. Any unapproved items may be confiscated or denied entry to ensure safety and prevent facility damage.


9. Food Allergy Disclaimer

  • Mini Muskogee is not responsible for allergic reactions or medical issues arising from food brought into or consumed within the facility unless caused by proven negligence.
  • Guests are responsible for monitoring their children for potential allergen exposure.


10. Membership Terms

  • Mini Muskogee memberships are valid for a 12-month period and renew automatically on an annual basis unless cancelled prior to renewal.
  • Membership benefits are associated with the specific member(s) listed at purchase and are non-transferable.
  • To qualify for the annual complimentary party benefit, the membership holder must request the party.
  • If the membership term is less than ninety (90) days from the purchase or renewal date, and the membership holder cancels the membership within ninety (90) days after using a party package (DIY or VIP), the membership holder will be responsible for paying 50% of the full price of the party package.
  • Mini Muskogee reserves the right to modify, update, or change membership benefits, pricing, or included services at any time. Any changes will be communicated through the website or member email, and continued use of the membership constitutes acceptance of the updated terms.
  • Memberships, party benefits, and member-only privileges are non-transferable and may only be used by the individuals listed on the membership. Misuse of membership benefits—including sharing, transferring access, or falsifying member identity—may result in immediate cancellation without refund.


Cancellation Policy:

  • Members may cancel at any time.
  • A $79 cancellation fee applies to all memberships cancelled before the end of the 12-month term.
  • Membership fees are non-refundable, except where required by law.
  • Canceling a membership results in the immediate loss of all membership benefits, including the annual complimentary party (one per year) and access to events.


11. Parties Policy

  • All party bookings require a deposit or full payment as specified at checkout.
  • Parties are non-refundable within two (2) weeks of the scheduled party date.
  • Rescheduling may be allowed based on availability but is not guaranteed.
  • Failure to appear on the scheduled date results in forfeiture of all payments.


12. Field Trip Policy

  • Field trips require advance reservation and payment.
  • Field Trips are non-refundable within two (2) weeks of the scheduled date.
  • Rescheduling may be allowed depending on facility availability but is not guaranteed.
  • Schools, home school groups, and organizations must provide appropriate adult supervision during field trips, following ratios that meet or exceed state recommendations. Mini Muskogee staff are not responsible for supervising students unless otherwise agreed in writing.


13. Refund Policy

Mini Muskogee maintains a strict no-refund policy on the following:

  • Open Play Admissions
  • Events
  • Gift Cards
  • Punch Passes


All sales of the above items are final.

14. Facility Rules

General Safety

  • Children must be supervised by a parent or legal guardian at all times unless participating in a designated drop-off program.
  • Running is not allowed; hallways and seating areas must remain calm and orderly.
  • Climbing on furniture, decorations, or non-play structures is prohibited.
  • Only Mini Muskogee staff may operate or adjust equipment, props, or play installations.
  • Children may not throw toys.


Cleanliness & Hygiene

  • Hands must be washed or sanitized before entering the play area and after restroom use.
  • Food, drink, and chewing gum are permitted only in designated areas.
  • Socks are required in all soft-play and sensory areas unless otherwise stated.
  • Guests must dispose of trash properly and help maintain a clean play environment.


Health & Illness

  • Children or adults exhibiting symptoms of illness—including fever, rash, vomiting, diarrhea, active cough, or contagious conditions—may not enter the facility.
  • Mini Muskogee reserves the right to request that a guest leave if illness symptoms appear during a visit.
  • Any injuries, spills, or hazardous conditions must be reported to staff immediately.


Behavior Expectations

  • Roughhousing, aggressive behavior, bullying, and inappropriate language are strictly prohibited.
  • Respectful play is required; children must share play spaces and equipment.
  • Parents/guardians are responsible for correcting unsafe or disruptive behavior immediately upon request from staff.


Facility Property & Equipment

  • All equipment must be used only as intended. Misuse may result in removal from the facility.
  • Props, toys, costumes, and play materials must remain in their designated areas.
  • Damage to equipment, walls, fixtures, props, or furniture must be reported to staff immediately.


Personal Items

  • Mini Muskogee is not responsible for lost, stolen, or damaged personal belongings.
  • Strollers must remain in designated areas and may not block hallways or exits.
  • Outside toys or equipment may not be brought into the facility unless approved by staff.


Safety & Security

  • Emergency exits must remain unblocked at all times; children may not play near emergency doors.
  • Guests must follow all posted signs, safety instructions, and staff directions.
  • Mini Muskogee may conduct routine safety checks of play areas throughout the day.


Photography & Media

  • Guests may take photos of their own children only. Photography of other guests without permission is not allowed.
  • Professional photography sessions must be approved in advance.


Capacity & Time Limits

  • Mini Muskogee reserves the right to limit entry during peak times or when at capacity.
  • Time limits may apply during high-traffic periods, special events, or holidays.


Food & Drinks

  • All food and drinks must stay in the party room.
  • No party food, snacks, or drinks may be at the tables around the play floor.
  • No food or drink in child's hands while playing.


Foam Pit

  • Children must be supervised at all times when using the foam pit; parents and guardians are responsible for monitoring safe behavior.
  • Only one person may jump into the foam pit at a time to prevent collisions or injuries.
  • No diving headfirst into the foam pit. All entries must be feet-first, sitting, or carefully jumping in an upright position.
  • No flipping, twisting, or acrobatic stunts are allowed.
  • No running into or around the foam pit area
  • Use caution when entering and exiting the foam pit; do not climb on railings, walls, or surrounding equipment.
  • Do not throw foam blocks or remove them from the pit area.
  • Keep foam blocks inside the pit at all times; do not stack them or use them to build structures outside the pit.
  • Shoes are not permitted in the foam pit. Socks or bare feet only, depending on facility rules.
  • No food, drinks, toys, or personal items may enter the foam pit.
  • Empty pockets before use to prevent lost items and choking hazards.
  • Children must be able to climb out independently, unless assistance is needed for safety.
  • Do not bury yourself or others under the foam blocks.
  • Guests exhibiting unsafe or rough play may be asked to leave the foam pit area
  • Report any damaged, loose, or unsafe equipment to staff immediately.
  • Mini Muskogee is not responsible for lost items that fall into the foam pit or become lodged under equipment.
  • Guests with injuries, medical conditions, or mobility restrictions should use caution or avoid the foam pit entirely.
  • Staff instructions must be followed at all times for safety.


15. Property Damage

  • Parents and legal guardians are financially responsible for all damage caused by their child(ren) to Mini Muskogee’s property, equipment, fixtures, furniture, and any other assets.
  • Mini Muskogee reserves the right to assess repair or replacement costs and invoice the parent or guardian for the full amount.
  • Public schools, home school organizations, and the parents or legal guardians of home-schooled children shall be liable for any and all damage to Mini Muskogee property, equipment, fixtures, or furnishings caused by their students or children. Mini Muskogee reserves the right to assess and invoice the full cost of repair or replacement to the responsible school, organization, parent, or guardian. Nonpayment may result in the suspension of facility access, cancellation of future reservations, and any additional remedies permitted by law.
  • Failure to pay for damages may result in suspension of access, cancellation of membership, or pursuit of reimbursement through legal means if necessary.
  • In the event that legal action is required to recover costs associated with property damage, the responsible public school, home school organization, or parent/legal guardian shall be liable for the full amount of the assessed damages, in addition to all associated legal fees, court costs, and collection expenses incurred by Mini Muskogee.


16. Jurisdiction & Governing Law

  • These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of Oklahoma. Any disputes shall be resolved within the appropriate courts located in the State of Oklahoma.


17. Dispute Resolution Clause

  • Any dispute, claim, or controversy arising from the use of Mini Muskogee’s facility or services shall first be addressed through informal negotiation. If unresolved, disputes shall be settled through binding arbitration or small claims court, at Mini Muskogee’s discretion. Guests waive the right to participate in class-action lawsuits.


18. Severability Clause

  • If any portion of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.


19. Acceptance of Terms

  • By entering the facility, booking a party, joining a membership, purchasing a pass, or participating in any activity, you acknowledge that you have read, understood, and agreed to these Terms of Service. Continued participation constitutes ongoing acceptance of all current and updated terms.


20. Amendments

  • Mini Muskogee reserves the right to update or modify these Terms at any time. Updated versions will be posted on our website and take effect immediately unless stated otherwise.

PARENT/GUARDIAN AGREEMENT & LIABILITY WAIVER

Important: This document is designed as a practical starting point for Mini Muskogee's drop-off program. It is not a guarantee against liability and should be reviewed by an Oklahoma attorney before use. A waiver cannot legally excuse every type of conduct or eliminate duties imposed by Oklahoma law or child-care licensing rules.

1. Nature of the Program
Mini Muskogee Play Museum (“Mini Muskogee,” “we,” “us,” or “our”) provides children's play, enrichment, events, and
designated drop-off programming. A drop-off program means a parent or legal guardian may leave an enrolled child at
Mini Muskogee for the specific period purchased or scheduled, subject to program rules, capacity, staffing, and
applicable law. Drop-off care is available only through programs specifically identified by Mini Muskogee as drop-off
programs.


2. Parent/Guardian Responsibility Before Drop-Off
The parent or legal guardian must provide complete and accurate information about the child before the first drop-off
and must promptly update Mini Muskogee when information changes. The parent/guardian must disclose allergies,
medical conditions, medications, developmental or behavioral needs, toileting needs, communication needs, dietary
restrictions, custody restrictions, and any other information reasonably necessary for safe care. Failure to disclose
relevant information may create safety risks and may result in suspension or termination of drop-off privileges.


3. Authorized Pick-Up / Release of Child
Mini Muskogee will release a child only to the parent/legal guardian or an adult authorized in writing by the parent/legal
guardian, unless required otherwise by law or a valid court order. The parent/guardian is responsible for keeping the
authorized pick-up list current. Mini Muskogee may require government-issued photo identification. A child will not be
released to a person who appears impaired, threatening, or otherwise unable to safely take custody of the child; Mini
Muskogee may contact an alternate authorized person or emergency contact and, when appropriate, emergency
services or law enforcement.


4. Check-In and Check-Out
A parent/guardian must complete the required check-in and check-out process. The parent/guardian must record or
verify the actual drop-off and pick-up time. A child is considered in Mini Muskogee's care only during the program's
scheduled drop-off period after the child has been accepted by staff and checked in. The parent/guardian must remain
available by telephone during the entire period of care.


5. Late Pick-Up
Parents/guardians agree to pick up children by the scheduled end time. Late pick-up may result in a late fee, loss of
drop-off privileges, or both, according to the program's current fee schedule. If a child remains after closing and Mini
Muskogee cannot reach the parent/guardian or authorized contacts, Mini Muskogee may take reasonable steps
necessary to protect the child's safety and comply with applicable law.


6. Emergency Contact and Medical Authorization
The parent/guardian authorizes Mini Muskogee staff to contact the listed emergency contacts and to seek emergency
medical evaluation or treatment for the child when staff reasonably believe it is necessary and a parent/guardian cannot
be reached in time. The parent/guardian accepts financial responsibility for medical care, ambulance services,
prescriptions, or other expenses incurred for the child. This authorization does not require Mini Muskogee to administer
medical treatment beyond what staff are trained, authorized, and legally permitted to provide.


7. Illness / Health Exclusion
Children should not be dropped off when experiencing fever, vomiting, diarrhea, contagious illness, unexplained rash,
significant respiratory symptoms, or other symptoms that make participation unsafe or inappropriate. Mini Muskogee
may require a child to be picked up if illness symptoms develop during care. Parents/guardians agree to promptly pick
up an ill child and remain reachable while the child is in care.


8. Allergies, Food, and Medication
Parents/guardians must provide complete written information about allergies, dietary restrictions, medications, and
medical action plans before care begins. Parents/guardians must provide medications only in the manner permitted by
Mini Muskogee policy and applicable law. Mini Muskogee cannot guarantee an allergen-free environment.
Parents/guardians remain responsible for providing required emergency medications and instructions when applicable
and legally permitted.


9. Toileting and Personal Care
The parent/guardian must accurately disclose the child's toileting status and any assistance the child requires. Mini
Muskogee may limit participation in a drop-off program if the child's personal-care needs exceed the program's staffing,
training, facilities, or permitted scope of care. Staff will follow the program's written hygiene and personal-care
procedures.


10. Behavior and Safety
Children must follow age-appropriate safety rules and staff directions. Hitting, biting, kicking, bullying, dangerous
climbing, intentional property destruction, threatening conduct, or other unsafe behavior may result in immediate
removal from an activity, parent notification, early pick-up, suspension, or termination of drop-off privileges.
Parents/guardians remain responsible for damage caused by their child as permitted by law.


11. Assumption of Risk
The parent/guardian understands that children's play and group activities involve inherent risks, including but not
limited to slips, trips, falls, collisions, playground and soft-play equipment risks, contact with other children, ordinary
childhood accidents, and risks associated with active indoor play. The parent/guardian knowingly and voluntarily
assumes these inherent risks on behalf of the child to the fullest extent permitted by Oklahoma law.


12. Release, Waiver, and Covenant Not to Sue
To the fullest extent permitted by applicable Oklahoma law, the parent/guardian, on behalf of the parent/guardian and
the child, releases and agrees to hold harmless Mini Muskogee Play Museum, its owners, members, managers,
employees, contractors, volunteers, agents, and affiliates from claims for injury, illness, death, property damage, or loss
arising from the child's participation in the drop-off program, including risks inherent in children's play and ordinary
negligence, to the extent such a release is enforceable under Oklahoma law. This provision does not purport to release
liability that cannot legally be waived, including any liability prohibited from being waived by applicable law.


13. Indemnification
To the fullest extent permitted by law, the parent/guardian agrees to indemnify and hold harmless Mini Muskogee and
the persons identified above from claims, damages, costs, or reasonable attorney fees arising from the
parent/guardian's or child's intentional or negligent acts, material misrepresentations, failure to disclose relevant safety
information, or violation of these Terms, except to the extent prohibited by law.


14. No Guarantee of Injury-Free Care
Mini Muskogee will use reasonable safety practices and supervision appropriate to the program. However, no facility or
childcare/play program can guarantee that a child will never be injured, become ill, or experience an emergency. The
parent/guardian acknowledges this and understands that supervision does not eliminate ordinary risks of childhood
play.


15. Personal Property
Mini Muskogee is not responsible for lost, stolen, or damaged personal property. Parents are encouraged to label
belongings and avoid sending valuables, toys, electronics, or unnecessary items with the child.


16. Photography / Video
Unless the parent/guardian separately opts out in writing, the parent/guardian understands that photographs or video
may be taken during Mini Muskogee activities for operational, educational, or promotional purposes, subject to Mini
Muskogee's media practices. A parent/guardian may request that the child not be used in promotional media by
notifying Mini Muskogee in writing.


17. Custody and Legal Authority
The parent/guardian signing this agreement represents that they have legal authority to enroll the child and authorize
the child's participation. Any custody order, restraining order, or other legal restriction affecting pick-up or access must
be provided to Mini Muskogee in advance. Mini Muskogee may rely on written documentation provided to it and may
seek legal guidance when a dispute arises.


18. Program Termination
Mini Muskogee may refuse or terminate drop-off participation when necessary for safety, staffing, licensing compliance,
repeated rule violations, nonpayment, inaccurate information, unsafe behavior, or other legitimate operational reasons.
Refunds, credits, and rescheduling are governed by the program's posted policies.


19. Compliance With Oklahoma Law
These Terms are intended to be interpreted under Oklahoma law. Nothing in these Terms is intended to waive, replace,
or circumvent any child-care licensing requirement, mandatory reporting duty, health/safety requirement, or other
non-waivable legal obligation. If any provision is found unenforceable, the remaining provisions will remain in effect to
the fullest extent permitted by law.


20. Acknowledgment and Voluntary Agreement
I certify that I am the parent or legal guardian of the child(ren) listed below, that the information I have provided is
complete and accurate to the best of my knowledge, and that I have read and understand these Terms. I understand
that I am giving up certain legal rights through the release and waiver provisions to the extent they are enforceable. I
have had the opportunity to ask questions and voluntarily agree to these Terms.
